El juez Wilfredo Núñez, de Chuquisaca, informó que una mujer presuntamente registrada como madre de Pedro Montenegro, alias Pedro Hoffman, tramita ante la justicia una demanda de negación de maternidad contra el narcotraficante, reportó el periodista Iván Ramos de la Red ERBOL.
“Es una demanda de negación de maternidad precisamente por la supuesta madre del señor Pedro Montenegro Paz que se hacía pasar como Pedro Hoffman Sainz. Es la demanda que se ha plantado en este despacho judicial y lógicamente va a seguir el curso que la ley establece”, sostuvo.
El proceso es porque Pedro Montenegro usó los apellidos de Hoffman Sainz, una familia sucrense, para evadir la acción de la justicia.
La figura de negación de paternidad o maternidad es utilizada por las personas que aparecen como progenitores de un hijo que no es suyo.
De acuerdo con el Código de las Familias, sólo se puede demandar la negación de maternidad en el plazo máximo de seis (6) meses desde que ha tomado conocimiento de su registro.
Según las investigaciones, Pedro Montenegro tramitó la identidad de Hoffman en 2009, pero el caso recién se hizo conocido desde abril de este año.
El juez Núñez dijo que la demanda de negación de maternidad cumple contra las condiciones de admisibilidad y que ahora corresponde remitir diligencias a Santa Cruz, para que se cite a Montenegro en el penal de Palmasola.
Montenegro ya enfrenta otro proceso por la falsificación por su identidad como Pedro Hoffman. Por cuerda separada se lo investiga por legitimación de ganancias ilícitas y tráfico.
